A Lawsuit Requesting the Administrative Authority to Issue or Amend Regulations : A Study and Analysis of the Central Administrative Court Judgment No. E. 36/2566

Abstract
When the executive branch is delegated authority by the legislative branch to issue regulations detailing and implementing rights prescribed by an Act, but fails to do so, it results in harm to the public. This is because the rights and benefits granted by law cannot be effectively exercised in practice. In such cases, it becomes the duty of the judiciary to protect the rights of the people. The Thai Administrative Court plays a crucial role in safeguarding citizens rights against administrative actions. This raises the issue of how the current Thai Administrative Court mechanisms can protect individuals’ rights in cases where the administrative authorities fail to issue the necessary regulations to clarify the details of an Act. This article explores the concepts and procedural system of the German Administrative Court, which has interpreted existing type of Cases to fill such gaps in rights protection. The discussion will trace theoretical foundations, the evolution of legal action forms, academic debates, and relevant judicial rulings. These will be compared with the Central Administrative Court judgment E. 36/2566, where citizens sued to compel the administrative authorities to issue regulations. This leads to the conclusion on the role of the Administrative Court in protecting rights
