พัฒนาการของบทบัญญัติที่เกี่ยวกับสัญญาทางปกครองของสาธารณรัฐอิตาลี

Abstract

The administrative contract disputes are one of cases within the jurisdiction of the Administrative Courts under section 9 paragraph one (4) of the Act on Establishment of Administrative Courts and Administrative Court Procedure, B.E. 2542 (1999). But the written law on administrative contracts is relatively rare. In addition, some of the legal rules governing administrative contracts are still scattered in many laws. A Comparative Study of Law Enactment Concepts on Administrative Contracts and the study of the principles of administrative contract derived from positive law and jurisprudence of the Italian and Thai Administrative Courts are therefore beneficial to the development of legal principles on administrative contracts in Thailand. And the results of the study can be used as supporting information for drafting the law on administrative contracts of Thailand in the future as well.
