บทบาทของศาลรัฐธรรมนูญไต้หวันในการคุ้มครองความเสมอภาคระหว่างเพศ

บทคัดย่อ
ไต้หวันได้รับอิทธิพลความคิดด้านการเมืองการปกครองจาก ดร.ซุน ยัตเซ็น โดยเป็นรัฐเสรีประชาธิปไตยที่มีรัฐธรรมนูญลายลักษณ์อักษรเป็นกฎหมายสูงสุดของประเทศ รัฐธรรมนูญไต้หวันมีบทบัญญัติที่มีที่มาจากหลักประชาธิปไตยและหลักนิติรัฐ รวมถึงมีบทบัญญัติเรื่องหลักความเสมอภาคโดยเฉพาะเรื่องความเสมอภาคระหว่างเพศที่บัญญัติสอดคล้องทัดเทียมกับนานาชาติ ไต้หวันมีศาลรัฐธรรมนูญทำหน้าที่ตรวจสอบการรับรองสิทธิเสรีภาพและความเสมอภาคตามรัฐธรรมนูญของประชาชน และมีบทบาทอย่างมากต่อการคุ้มครองรับรองหลักความเสมอภาคระหว่างเพศ บทความนี้นำเสนอเกี่ยวกับศาลรัฐธรรมนูญและแนวคิดเรื่องหลักความเสมอภาคของไต้หวัน พร้อมทั้งพิจารณาถึงบทบาทของศาลรัฐธรรมนูญไต้หวัน
ในการคุ้มครองความเสมอภาคระหว่างเพศจากตัวอย่างคดี 3 คดี ในประเด็นความเสมอภาคระหว่างชายและหญิง จากคดีเกี่ยวกับสมาคมนับถือบรรพบุรุษซึ่งศาลรัฐธรรมนูญวินิจฉัยไว้ 2 คดี ในปี ค.ศ. 2015 และปี ค.ศ. 2023 รวมถึงประเด็นความเสมอภาคของกลุ่มผู้มีความหลากหลายทางเพศในคดีปี ค.ศ. 2017 ที่ทำให้ไต้หวันเป็นประเทศแรกในทวีปเอเชียที่รับรองสิทธิให้บุคคลเพศเดียวกันสามารถสมรสกันได้
